1. Agreement
These Terms of Use (“Terms”) govern access to SmartHire, operated by COMPASS Recruitment (Geelong, Victoria, Australia). By creating an account or using the service, you agree to these Terms.

2. The service
SmartHire is a reverse talent marketplace connecting Australian engineering candidates with employers via anonymised profiles, soft intros, and paid request-to-interview (RTI) / unlock flows.
Features, pricing, and availability may change as the product matures. Staging and early-access environments may be incomplete or reset.
3. Accounts and eligibility
You must be 18+ and able to form a binding contract under Australian law.
Provide accurate information. Keep your login credentials secure. You are responsible for activity under your account.
We may suspend or close accounts that abuse the marketplace, misrepresent credentials, scrape data, or breach these Terms.
4. Candidates
You control openness, quiet-mode settings, and responses to soft intros and RTIs.
Identity and CV remain hidden from employers until you accept a paid unlock or paid RTI path as described in the product.
You warrant that profile information (including credentials) is true and not misleading.
5. Employers
Employers may browse anonymised cards, send soft intros, post job ads, and pay to unlock interview packs where the product allows.
You must not attempt to reverse-engineer candidate identity outside the product flows, or use contact details obtained via SmartHire for unrelated marketing without consent.
Fees for unlocks, ads, and related features are shown in-product. Demo/staging may use a ledger/invoice path instead of live card charges.
6. Payments and taxes
When Stripe (or another processor) is connected, card payments are processed by that provider — we do not store full card numbers.
Invoices and ledger entries may apply in demo or early staging. Prices are in AUD unless stated otherwise. You are responsible for any applicable taxes.
Refunds are handled case-by-case; contact us promptly if a charge looks incorrect.
7. Content and intellectual property
You retain ownership of content you upload. You grant us a licence to host and display it as needed to operate the marketplace.
SmartHire branding, software, and COMPASS materials remain our property (or our licensors’). Do not copy or scrape the service at scale.
8. Privacy
Personal information is handled under our Privacy Policy (/privacy). By using SmartHire you also acknowledge that policy.
9. Disclaimers and liability
SmartHire facilitates introductions; we do not guarantee hiring outcomes, candidate availability, or employer offers.
To the extent permitted by Australian Consumer Law, the service is provided “as is” for early access/staging, and our aggregate liability for claims relating to the service is limited to fees you paid us in the prior 3 months (or AUD $100 if none).
Nothing in these Terms excludes non-excludable rights under the Australian Consumer Law.
10. Governing law
These Terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction.
11. Changes
We may update these Terms as the product matures. Material changes will be noted on this page with a new effective date. Continued use after an update means you accept the revised Terms.
